Mcguiness2.com Orlando/Florida = Bad Business
I purchased an H2 from this company over 1 month ago. They have yet to pay off the vehicle I traded in and they have it for sale on there property. In the mean time I have been paying my payment on the car I "traded in" because i do not want it to affect my credit.
Is there anything legally I can do? Do they have a dead line before they have to pay it off?
My car payments get automatically deducted from my account every two weeks and I am on the 3rd payment on a vehicle that i dont even have in my garge.
Now i know they techinally have to pay the pay off amount but I am still eating the interest.
Feedback would be greatly appreciated -

Holy crap, get a freakin lawyer, when I traded in my car for my h3, they paid off the loan on that car and what was left over for what they didn't give me for my car, was added on to the total price of the h3

After leaving two voicemails today they finally returned my call. Here was the sales reps excuse "we mailed your payoff to the wrong bank and they just called us today to notify us, when we recieve the returned check we will send it to your credit union"
Bunch of gosh darn bull**** to me. I have a feeling they dont have the funds or they are trying to sell the car before they front the payoff money. They have got till the end of the week and Im going see what i can do legally.

Glad it worked out. The laws very by state. I had an issue like that with a Mercedes dealer in CA. Took getting Mercedes Benz Credit involved. Dealer was doing the same thing to a dozen people and using their cars as loaners. MBC threatened to pull the dealers floor plan and block the pending sale of the dealership and that got the dealer to take car of all of us.
I bought an X5 in December from this company and I traded in a vehicle. Two months later I am receiving late payment from the from the bank that I traded the vehicle. It has been two months and they have yet to make a payment. Owner's Wife Rosa is making excuses that she sent in the payment and one department is not talking to another. I spoke to the bank and plain and simple if a payment was submitted then it would post to the account but that was not the case. This family business is shady as **** and I going to pursue this.
