here's the thing I don't undertand. I understand the association having their by-laws and everything but how can they go against local and state laws? Don't see how that is legal....you are paying taxes to your township, county, and state so you should have rights like every other citizen of that state. Almost seems like these communites are like little communist towns.
That's exactly what I asked. His response was that the rules that they create are rules that don't exist in the county or state/federal books, so because you agree to live in this association you agree to adopt the rules.
The interesting thing is I already caught one that was against a federal law.
there is a federal law the FCC passed that says any homeowner legally has the right to own and install a Satellite Dish on your home. In our "booklet" it says you need approval from the association to do so.
here is the catch.
The rule says they can tell you where on your home you can install it, but have no right to say you can't have it. I'm having my friend read through this rule book and I'm going to bring to attention these rules that are unlawful to the builder before we close. I'm the kind of person that if something isn't right, I'm going to fix it.
Anyway, legally if you live in one of these developments, they can't impost rules that conflict with county, state or federal laws, BUT if no such rule or law exists, they can create one.
Like I said, our development is pretty laid back and they let you do pretty much everything and anything you want (except if you wanta pool, it has to be inground and not above ground). Other then that, they are good.
Hence the fact of me wanting to be on the board

Mike...
Run for the board. I don't think the age thing will hold you back. I have been on a HOA board for the plast 10 years, I was only 24 when I was first elected. Some of the older residents came up to me and told me they voted for me because I was young and had energy! Ihave been president for the past 5 years.
We have soem of the same rules that have been talked about....such as the satelite dish, it is a federal law that you can not prevent someone from istalling it although the HOA can tell the owner where it can be placed on the property. Many states are creating a lot of laws around how HOA can be ran becasue a few WACKOS get on these boards and think they can do whatever they want.

Y'all just quit your bitchen and comply...You bought into those hoitytoity neighbor hoods because of the status of snobbery..So suck it up, you deceided to lay in that bed so quit messing up the sheets...Now I got to go build an out house out of old barn board to **** off my HOA...By the way, Is there rules against livestock?....Moooooooooooooooooooo...

They can only be in your driveway for 48 consecutive hours apparently. I have a 2 car garage. I doubt that rule will be enforced much. It doesn't bother me too much though, because I am getting special insulation on the door and walls, and a 8 foot high garage door so hopefully I'll be able to store what I need in there (camper van here I come!)
LOL it's FAR from being a snobby neighborhood. Believe me I work with enough of them all day. I don't need to live near them too! That's why I'll run for the board and make sure I ban all automobiles except for ones that are in the Hummer line ;-)
