Don't confuse the actual no fault definition with what people think it is... I am allowed to claim under my policy... even though she was ticketed and was the cause... the no-fault comes in with the injury side of it.... but I do not have the "Limited Tort" option on my policy....

here is some info:

Currently 11 states and Puerto Rico have no-fault auto insurance laws. Michigan, New Jersey, New York and Pennsylvania have verbal thresholds. Florida’s no-fault law, which also had a verbal threshold, expired on October 1, 2007, but has been reenacted effective January 2008, see below. The other seven states—Hawaii, Kansas, Kentucky, Massachusetts, Minnesota, North Dakota and Utah—use a monetary threshold. Three states have a "choice" no-fault law. In New Jersey, Pennsylvania and Kentucky, motorists may reject the lawsuit threshold and retain the right to sue for any auto-related injury. Colorado’s law reverted back to the tort liability system in July 2003.

Shorty, I still can't get over how lucky your daughter was...someone was watching out for her.

MD...I can't believe your h2 is that messed up...doesn't look like a total from the pics....for a 35 MPH impact.....that much damage and now heading into a totaled vehicle range of damage does not say much for Hummers...that's terrible...sorry you have to go through all this.

it's not a total.... but the companies starting getting into that mode at 70-75% of the value of the truck.... it's a complete frame and labor to bolt all of it off and back on... that's only because the frame might not be able to be brought back to specs... it still drove straight... perfect actually... but they can't release it if anything on it isn't up to specs....
